{"id":4412,"date":"2017-01-14T15:04:45","date_gmt":"2017-01-14T15:04:45","guid":{"rendered":"https:\/\/really.zonky.org\/?p=4412"},"modified":"2017-01-14T15:05:10","modified_gmt":"2017-01-14T15:05:10","slug":"two-free-speech-myths","status":"publish","type":"post","link":"https:\/\/really.zonky.org\/?p=4412","title":{"rendered":"Two US Free Speech Myths"},"content":{"rendered":"<p>One of the things you regularly encounter online is the fetish Americans have for free speech; not entirely a bad thing, but some of what they believe is a bit of a myth. Part of the problem is that the first amendment to the US constitution is just a little vague and handwavey :-<\/p>\n<blockquote><p>or abridging the freedom of speech, or of the press<\/p><\/blockquote>\n<p>First of all, what is that word &#8220;abridging&#8221; supposed to mean? It literally means shortening which makes the phrase nonsense even if it was supposed to be read as if &#8220;restricting&#8221; was the word used. Of course the meaning of language does change and it could well be that at the time, &#8220;abridge&#8221; would have unambiguously meant restrict. And &#8220;freedom of speech&#8221;? We normally take that to mean any form of expression whether spoken, written, drawn, or generated in some other way. But was that what was meant?<\/p>\n<p>But now onto the myths &#8230; the first is a simple one and there is no real debate about it.<\/p>\n<p>The right of free speech does not give you a right to be published by a third-party. If you are on Facebook for example, there is no right to free speech there &#8211; Facebook can decide to arbitrarily restrict what you can say perfectly legally. The\u00a0<em>government<\/em> cannot restrict what you self-publish, but your publisher (including forum admins, mailing list admins, etc.) is free to refuse to publish for any reason at all.<\/p>\n<p>Ultimately the only recourse to such censorship is to self-publish which is relatively easy on the Internet.<\/p>\n<p>The second &#8220;myth&#8221; is a bit more debatable, but arguably the right to free speech is more about being free to criticise the government; in an era of <a href=\"https:\/\/en.wikipedia.org\/wiki\/L%C3%A8se-majest%C3%A9\">lese-majesty<\/a> and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Seditious_libel\">seditious libel<\/a>, the major concern of the American revolutionaries was with\u00a0<em>political<\/em> free speech. And whilst there has been free speech, there have always been restrictions on that freedom or consequences :-<\/p>\n<ul>\n<li>Obscenity (as determined by the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Miller_test\">Miller test<\/a>).<\/li>\n<li><a href=\"https:\/\/en.wikipedia.org\/wiki\/Imminent_lawless_action\">Inciting imminent lawlessness<\/a>\u00a0such as encouraging a lynch mob. Although this one can be a dangerously slippery slope given it&#8217;s historical <a href=\"https:\/\/en.wikipedia.org\/wiki\/Schenck_v._United_States\">use<\/a> against people protesting the draft.<\/li>\n<li>Commercial speech including advertising, and copyright.<\/li>\n<li><a href=\"https:\/\/en.wikipedia.org\/wiki\/Defamation\">Libel and slander<\/a>.<\/li>\n<\/ul>\n<p>So when looking at a particular restriction on free speech &#8211; such as hate speech (i.e. racial or religious hatred) &#8211; it is perfectly feasible for a law to be enacted to make such speech punishable in some form.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-large wp-image-4043\" src=\"https:\/\/i0.wp.com\/really.zonky.org\/wp-content\/uploads\/2015-12-31-seagull-in-the-light.p1.jpg?resize=683%2C1024&#038;ssl=1\" alt=\"\" width=\"683\" height=\"1024\" srcset=\"https:\/\/i0.wp.com\/really.zonky.org\/wp-content\/uploads\/2015-12-31-seagull-in-the-light.p1.jpg?resize=683%2C1024&amp;ssl=1 683w, https:\/\/i0.wp.com\/really.zonky.org\/wp-content\/uploads\/2015-12-31-seagull-in-the-light.p1.jpg?resize=200%2C300&amp;ssl=1 200w, https:\/\/i0.wp.com\/really.zonky.org\/wp-content\/uploads\/2015-12-31-seagull-in-the-light.p1.jpg?resize=768%2C1152&amp;ssl=1 768w, https:\/\/i0.wp.com\/really.zonky.org\/wp-content\/uploads\/2015-12-31-seagull-in-the-light.p1.jpg?w=1601&amp;ssl=1 1601w, https:\/\/i0.wp.com\/really.zonky.org\/wp-content\/uploads\/2015-12-31-seagull-in-the-light.p1.jpg?w=1390&amp;ssl=1 1390w\" sizes=\"auto, (max-width: 683px) 100vw, 683px\" \/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>One of the things you regularly encounter online is the fetish Americans have for free speech; not entirely a bad thing, but some of what they believe is a bit of a myth.
